Helping Columbus, OH Nursing Home Residents, Their Spouses and Families
The Dickson Firm represents nursing home residents and their families in cases against the owners and the operators of nursing homes throughout the State of Ohio. Did you know that Columbus nursing homes are legally required to provide their residents with good care? And they are legally required, under state and federal law, to have a sufficient number of properly trained staff to care for their residents.
It is also illegal for a nursing home to neglect or abuse its residents. There are state laws and federal laws that were passed to protect nursing home residents and to guarantee them certain rights. If someone you love was neglected or abused in a nursing home, there is something you can do.
Columbus Bedsore Attorney
In Columbus nursing homes, bedsores and pressure ulcers are a serious concern. Inadequate care and outright neglect can lead to the development of severe bedsores, including Stage 4 ulcers, which can be life-threatening and result in wrongful death.
Bedsores are generally caused due to inadequate care, neglect or even intentional abuse. It is not unusual for a nursing home resident, their spouse or a family member to contact an attorney once bedsores or pressure ulcers occur or are observed. These sores can be immensely painful – and potentially life threatening for the resident. For family members, evidence of a bedsore can be shocking.
Tragic Injuries from Nursing Home Falls
One of the most common types of cases that we handle here at The Dickson Firm involve a nursing home resident who has fallen. Tragically, when a nursing home resident falls, they can suffer a fracture, they can suffer a head injury, they can suffer a dislocation. They can suffer any number of a series of very serious, and sometimes even fatal, injuries.
Nursing homes like to argue that not all falls can be prevented. And while it is probably true that not all falls can be prevented, many can be prevented, and even if a fall cannot be prevented, if a nursing home resident is receiving appropriate care, then the staff can prevent that resident from suffering serious injury even if they do fall.
Assault in Columbus Nursing Homes
Tragically, nursing home residents are sometimes assaulted by the staff at the nursing home, by other residents, and even by visitors to the nursing home. Blake Dickson, and his team have represented individuals and their families in cases where nursing home residents have been severely injured as a result of assault.
Remember – Columbus nursing homes have a duty to keep their residents safe and provide care within a safe environment. If someone you love has been assaulted at a nursing home, you can talk with one of the experienced Ohio nursing home attorneys at The Dickson Firm at 1 (800) OHIO-LAW or (1-800-644-6529).
Elopement Cases in Columbus Nursing Homes
"Elopement" refers to when a nursing home resident leaves the nursing home unattended. When nursing home residents wander away, they are potentially more susceptible to falls or other dangers as they are no longer within the care of the facility.
Nursing homes are legally obligated, pursuant to federal law, to provide their residents with "adequate supervision" to prevent accidents. They are legally obligated, pursuant to the law in Ohio, the Nursing Home Resident's Bill of Rights, to provide the residents with a safe environment. If a nursing home is taking care of a resident who is not able to leave the facility safely on their own, and this applies to most if not all nursing home residents, then the nursing home has a legal obligation to make sure the residents do not leave the nursing home unattended.
Nursing Homes in Columbus OH to Avoid
Nursing homes in Columbus, and the communities surrounding Columbus, can be found and compared to each other, for their level of care through a Medicare website found here. Find and compare Medicare-certified nursing homes based on a location, and compare the quality of care they provide and their staffing. The overall rating is based on a nursing home's performance on 3 sources: health inspections, staffing, and quality measures. The overall star rating for nursing homes lets you compare nursing homes on topics you consider most important, and gives you a “snapshot” of the quality of each nursing home.
Why would you want to avoid these home? Because they have recent issues with their residents, including:
- significant quality of care issues with respect to their residents
- escalating penalties based on their level of care (or lack thereof)
- serious injuries as a result of an assault, abuse, neglect and elopement
- health related issue related to over medication and under medication
